Several amendments to the Electoral Code, proposed by Promo-Lex

The members of the Central Electoral Commission (CEC) must work permanently within the institution, and their appointment must be made by all three powers in the state, and not only by the Parliament, as it is at present. These are the proposals for amending the Electoral Code coming from the "Promo-Lex" Association and presented today, July 14, by the program director of this organization, Pavel Postică, during a public consultation at the Parliament, Radio Moldova reports.

According to the program director of "Promo-Lex", all provisions that limit the access of observers to the electoral and subscription lists must be removed from the bill. At the same time, the activity of observers must be allowed in the pre-election period.

"If we analyze the electoral polls, we see that 60% of the voters in the Republic of Moldova create their opinions about an election and for whom they vote in the pre-election period. Both religious denominations and non-profit organizations are part of civil society. Religious cults are prohibited from electoral agitation, and non-commercial organizations are prohibited from engaging in any form in the election campaign. Two different provisions in the Electoral Code. Either we forbid everyone to get involved in any form, or they are forbidden the electoral agitation, because from here derives the withdrawal of the accreditation of the observers," declared Pavel Postică.

In his opinion, the CEC, as well as all its members, must be permanently active. It would also be necessary to reduce the number of permanent members from nine to seven.

"The reduction from nine to seven permanent members would come with certain reductions in the state budget. Likewise, the mechanism for appointing CEC members must be modified, so that all three powers in the state have the possibility to delegate people to the CEC, and not only the Parliament. One member, the last, who is odd, to be appointed by the president. In this way, the institution will wash away that political aspect," Pavel Postică also mentioned.

TRM.MD recalls that, on July 9, the Parliament of the Republic of Moldova voted, in the first reading, several amendments to the Electoral Code. The initiators of the project mention that the document aims to achieve some addresses of the Constitutional Court and to adjust some provisions of the Electoral Code to the norms of the Administrative Code, as well as to improve the electoral procedures.

In this context, yesterday, July 13, the Association "Promo-Lex" launched a public appeal calling on the Parliament of the Republic of Moldova to ensure a transparent and inclusive process in the examination and adoption of the draft law on amending electoral legislation with the participation of all stakeholders, as well as to withdraw from this project the dangerous provisions for the organization and development of a free and fair electoral process, the activity of the electoral observers and for the equidistant and correct reflection of the electoral campaign by the mass media.
