The CEC rejects the accusations of non-compliance with the legislation regarding the financing of the electoral campaign
The Central Electoral Commission (CEC) issued a statement rejecting the accusations regarding the non-compliance with the legal provisions regarding the financing of the electoral campaign.
According to the CEC, the provisions of art. 1 of the Electoral Code establishes that in the general parliamentary and local elections the quality of electoral competitor is held by the party and the electoral bloc that has nominated candidates for elective positions. In the presidential elections, only the person designated for the position of President of the Republic of Moldova has the quality of electoral contestant. Under these conditions, the political party and the electoral bloc do not identify with the candidate, and any financial support by a political party of the candidate it appoints is made in compliance with the conditions applicable to the legal entity, within the established ceiling, of 12 average monthly salaries on economy for the current year.
The CEC notes that in the 2016 presidential election the candidate for head of state also had a different identity from the party and the electoral bloc, but the donation ceiling at that stage was much higher, up to 400 average monthly salaries per economy. The reduction of the ceilings for the financial support of the activity of the political parties and of the electoral campaigns was made by amending the electoral legislation in August 2019 at the initiative of the political party which today comes with accusations against the CEC. According to the draft law amending the Electoral Code (draft law no. 263/2020), the CEC proposed that political parties and electoral blocs that nominate candidates be granted the status of electoral contestant.
"The electoral fund can be opened until the registration of the electoral contestant, provided that any receipts and expenses from this account are made only after the registration of the electoral contestant. In this regard, we mention that the two electoral contestants already registered with the CEC can open a bank account, receive donations and make expenses. Regarding the financing of the electoral campaign for the presidential election, the CEC issued a circular addressed to the political parties that brings clarity to some norms included in the electoral legislation on this subject. This comes as a result of the examination of the financial reports of the initiative groups for supporting the candidates for the position of President of the Republic of Moldova, where the CEC noted that it was allowed to exceed the ceilings provided by the legal framework," said the CEC.
In this context, the CEC calls for calm all electoral subjects, especially electoral contestants, media institutions and civil society and urges them not to involve the commission in political games and to strictly observe the legal provisions for a good organization and conduct of the November 1 election.
