European Commission recommends EU states not to penalize persons who have exceeded their legal stay in the Schengen Area

Thus, the European Commission recommends that EU Member States grant these citizens long-term national visas or temporary residence permits. This is the case of the citizens of the countries that benefit from the visa-free regime with the EU and who have exceeded the period of legal stay in the Schengen Area (90 days accumulated within 6 months) due to the restrictions imposed.

Likewise, the European Commission recommends that sanctions and other administrative penalties be not applied for such cases, and that the respective cases are not taken into consideration when examining future visa applications.

The citizens of the Republic of Moldova, who are in the situation of exceeding the term of legal stay in the Schengen Area due to the restrictions imposed in the context of the COVID-19 virus, could refer to the respective solutions as an argument during the contacts with the immigration authorities of the State of the Space Schengen where they are in.
