The notification of Maia Sandu, partially admitted by the Constitutional Court

The Constitutional Court of Moldova (CCM) partially admitted the notification submitted by the country's president, Maia Sandu, who requested that the constitutionality of several articles of law that limit the resigning Government in the exercise of its attributions be verified. By today's ruling, some limitations imposed on the Executive have been lifted and others have been left in force.

Thus, the magistrates of the CCM decided that, until the amendment of the law by the Parliament, the Government whose term of office has ceased will be able to appoint or nominate persons other than ministers or in public office for a specified term until a certain term new appointment of the same person or of another made by the Government with full powers.

The magistrates of the High Court recognized as constitutional the provisions of the Law on Government in the part that prohibits the Cabinet of Ministers whose mandate has ceased to dismiss persons with public dignity or civil servants except in cases of objective impossibility to perform the duties.

At the same time, the notification regarding the control regarding the constitutionality of some interdictions applied to the Government whose mandate ended, including the one regarding the impossibility of concluding international treaties involving financial commitments for the Republic of Moldova, was declared inadmissible.

The decision of the Constitutional Court is final, cannot be appealed and enters into force on the date of adoption.
